How we collect, use and protect the information you give us through this website.

Introduction

Bent River Tree Care (“Company”, “we” or “us”) respects your privacy and is committed to protecting it through its compliance with this policy. This policy describes the types of information we may collect from you, or that you may provide, when you visit https://www.bentrivertreecare.com (the “Website”), and our practices for collecting, using, maintaining, protecting and disclosing that information.

This Privacy Policy applies to information we collect on the Website or in e-mail, text and other electronic messages between you and this Website. It does not apply to information collected by (a) us offline or through any other means, including on any other website operated by the Company or any third party; or (b) any third party, including through any content that may link to or be accessible from the Website.

Please read this policy carefully, before using the Website or submitting any personal information, to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is to not use our Website. By accessing or using the Website, you agree to this Privacy Policy. This policy may change from time to time. Your continued use of this Website after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

Information We Collect About You and How We Collect It

We collect two kinds of information: information you give us deliberately, and a small amount of technical information that any website receives automatically when your browser asks it for a page.

We collect it (a) directly from you, when you fill in the quote request form, call us, text us or send us an e-mail; and (b) automatically, in the server logs described under Automatic Data Collection below. We do not buy personal information about you from data brokers, and we do not receive it from advertising networks.

Information You Provide to Us

The information you provide to us may include (a) what you enter in the quote request form on our contact page, itemised under Quote Requests and Text Messages below; (b) an address, town or ZIP code you type into the firewood delivery-fee checker, which is looked up as described under Service Providers; (c) records and copies of your correspondence with us, including e-mails, text messages and any photographs you choose to send us; and (d) anything you tell us on the phone that we write down with your enquiry.

In summary, the personal information we hold about you may include:

First name and last name
E-mail address
Phone number
The address and postal code of the property the work is for
What you have asked us about, and any notes you added
That you ticked the consent box, and the exact wording you agreed to
Photographs you send us of a tree or a delivery spot
Your correspondence with us

There is no account to register for on this Website, nothing to log in to, no public comments or profiles, and no way to buy anything or pay us through it. We do not ask for and cannot accept card or bank details on this Website.

Quote Requests and Text Messages

This section describes the quote request form on our contact page, and takes precedence over anything more general elsewhere in this policy.

What the form collects. Your name, e-mail address, phone number, the street address and postal code of the property, the service you are asking about, and any notes you choose to add. We ask for the property address because we quote in person and have to know where the tree is.

What we do with it. We use it to contact you about your request, arrange a visit, and quote the work. Submissions are transmitted to and stored in our customer management system, which is operated on our behalf by the provider identified under Service Providers below.

What ticking the box means. The form carries a single consent box, and it has to be ticked to submit. Ticking it agrees that we may contact you by phone, text or e-mail — both about the request you have just made and with occasional news, offers and other marketing messages. There is no separate marketing box on this form: one tick covers both.

If you would rather not agree to the marketing part, call or text the office on 678-973-7773 and we will take your details that way instead. You will get exactly the same quote and the same service; we will not add you to the marketing list, and nothing about the work you receive depends on it.

You can stop the marketing at any time. Reply STOP to any text, use the unsubscribe link in any marketing e-mail, or e-mail us at kevin@bentrivertreecare.com. We will still reply about a quote you have asked for, and it does not affect the service.

Text messages. If you give us a mobile number we may text you about your request. You can reply STOP at any time to stop receiving texts from us, or HELP for help. Message frequency varies. Message and data rates may apply.

Photographs you send us. We may ask you to text a photo — of a tree, or of where you would like a mulch load put. Those images come to us by ordinary text message and are kept with your enquiry. Please do not send anything in a photo you would not want us to keep.

We do not sell this information, and we do not share it with third parties for their own marketing.

What This Website Does Not Do

Much of what a privacy policy normally has to warn you about does not happen here, so rather than leave you to infer it from silence:

We do not sell, rent or trade your personal information to anyone, for any price.
We do not share your information with third parties so that they can market their own products to you.
We set no cookies of our own, and use no web beacons, tracking pixels or fingerprinting.
We run no analytics on this Website. We do not measure you at all.
There is no advertising on this Website, no ad network, and no interest-based or behavioural advertising anywhere on it.
We do not use your information to build a profile of you, and we make no automated decisions about you.

If any of this changes, this policy changes with it, and the date at the foot of the page changes too.

Automatic Data Collection

We do not use cookies. We set none of our own, and nothing on our pages sets one for advertising or analytics purposes. Our hosting provider may set a strictly necessary security cookie to protect the site from automated abuse; where it does, it exists only for that purpose and is not used to identify, track or profile you. There is nothing here that needs a consent banner.

What does happen automatically is ordinary web server logging. When your browser requests a page, our hosting provider records technical details of that request — typically your IP address, the date and time, which page or file was asked for, the response given, and your browser’s user-agent string. This is how every web server on the internet works, and it is what lets us keep the site running and secure. We do not use those logs to identify you, and we do not combine them with the information you send us through the form.

Because we do not track you across websites, the question of how to honour a browser “Do Not Track” signal does not arise on this Website.

Third-Party Content and Tracking

We carry no advertising and no third-party trackers. Two things on the Website do nevertheless cause your browser to contact a company other than ours, and you should know about both:

Typefaces. Our pages load their fonts from Google Fonts. Your browser therefore requests those files from Google, which necessarily reveals your IP address to Google. Google states that it does not use Google Fonts requests to build advertising profiles.
The firewood delivery-fee checker. If you type an address, town or ZIP code into it, that text is sent to a public address-lookup service to work out the distance. See Service Providers below.

Links on this Website to Facebook, Google, Nextdoor and other outside sites are ordinary links. Apart from the quote request form described above, nothing from those sites is embedded in our pages, and they receive nothing about you unless you click through, at which point their own privacy policies govern what happens.

Service Providers

We employ a small number of third-party companies to run this Website and handle enquiries. They have access to your personal information only to perform those tasks on our behalf, and are obliged not to disclose or use it for any other purpose. They are:

GroupFuel, our customer management system, which is built on HighLevel. Quote request form submissions are transmitted to and stored there. HighLevel’s privacy policy can be viewed at https://www.gohighlevel.com/privacy-policy
Cloudflare, which hosts this Website and serves every page of it. Cloudflare processes the server log data described above on our behalf. Their privacy policy can be viewed at https://www.cloudflare.com/privacypolicy/
Google Fonts, which serves the typefaces our pages are set in, as described above. Google’s privacy policy can be viewed at https://policies.google.com/privacy
The United States Census Bureau geocoder, and, if it cannot find an address, the OpenStreetMap Nominatim service. These turn what you type into the firewood delivery-fee checker into map coordinates so we can measure the distance from our yard. Only the address text you typed is sent; your name, phone number and e-mail address are not, because the checker does not ask for them and we do not have them at that point. Nothing you type into the checker is stored by us.

That is the complete list. We do not use advertising networks, analytics providers, or payment processors, because this Website does not advertise, measure or take money.

How We Use Your Information

We use the information you give us (a) to reply to you and answer what you asked; (b) to arrange and carry out a site visit, quote and, if you go ahead, the work itself; (c) to keep a record of the job and our correspondence about it; (d) to present the Website and its contents to you; (e) to comply with our legal obligations and to establish, exercise or defend legal claims; (f) for any other purpose we describe to you at the time you provide the information; and (g) for any other purpose with your consent.

Marketing. The consent box on the quote request form covers marketing as well as replies about your enquiry, so submitting that form does put you on our list for occasional news and offers. The form says so above the button, and Quote Requests and Text Messages above sets it out in full. If you reach us by phone, text or e-mail instead of the form, we do not add you to that list.

You can withdraw marketing consent whenever you like: reply STOP to any text, use the unsubscribe link in any marketing e-mail, or e-mail us at kevin@bentrivertreecare.com. Withdrawing it does not stop us replying to an enquiry you have made, and it does not affect the service you receive.

If you are from the European Economic Area (EEA), Bent River Tree Care’s legal basis for collecting and using the personal information described in this Privacy Policy depends on the personal information we collect and the specific context in which we collect it.

We may process your personal information because:

We need to perform a contract with you, or take steps at your request before entering into one
You have given us permission to do so
The processing is in our legitimate interests and it’s not overridden by your rights
To comply with the law

Retention of Data

We keep enquiry and customer records for as long as is necessary for the purposes set out in this Privacy Policy — in practice, for as long as we may need them to stand behind work we have done, and to comply with our legal, tax and insurance obligations, resolve disputes, and enforce our agreements. If you ask us to delete your information and we are not required to keep it, we will.

Server logs are kept for a short period for security and diagnostic purposes and are then discarded.

Transfer of Data

We are a Georgia company and your personal information is processed in the United States. Your personal information may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction, where the data protection laws may differ from those in your jurisdiction.

If you are located outside the United States and choose to provide information to us, please note that we transfer the data, including your personal information, to the United States and process it there. Your submission of that information represents your agreement to that transfer.

We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy.

Disclosure of Your Information

We do not sell your personal information, and we do not disclose it to third parties for their own marketing purposes. There is no opt-out to hunt for, because there is nothing to opt out of.

We may disclose aggregated or de-identified information, which does not identify any individual, without restriction.

We may disclose the personal information we collect or that you provide: (a) to the service providers listed above, who process it on our behalf and on our instructions; (b) to subcontractors we engage to carry out work you have asked for, and only so far as they need it to do that work; (c) to our insurers and professional advisers where necessary; (d) to a buyer or other successor in the event of a merger, sale or transfer of some or all of the Company’s assets, in which case the notice under Business Transaction below applies; (e) to fulfil the purpose for which you provided it; (f) for any other purpose disclosed by us when you provide the information; or (g) with your consent.

We may also disclose your personal information (a) to comply with any court order, law or legal process, including to respond to any government or regulatory request; (b) to enforce or apply our agreements with you; or (c) if we believe disclosure is necessary or appropriate to protect the rights, property, or safety of the Company, our customers or others.

Business Transaction

If we are involved in a merger, acquisition or asset sale, your personal information may be transferred. We will provide notice before your personal information is transferred and becomes subject to a different Privacy Policy.

Choices About How We Use and Disclose Your Information

Because this Website sets no cookies, runs no analytics and carries no advertising, the usual tracking choices do not apply here — there is nothing to turn off. The choices that do matter are these:

Marketing messages. The quote form's consent box covers them, so using the form puts you on the list. Reply STOP to any text, use the unsubscribe link in any marketing e-mail, or e-mail us, and we will take you off it. To stay off it in the first place, call or text the office rather than using the form.
How we contact you about your enquiry. Tell us if you would rather we called than texted, or the other way round, and we will.
Your information generally. Ask us to show you what we hold, correct it, or delete it — see Accessing and Correcting Your Information below.
The delivery-fee checker. If you would rather not have an address sent to an outside lookup service, do not use the checker — call or text us instead and we will work the fee out for you.

Accessing and Correcting Your Information

E-mail us at kevin@bentrivertreecare.com to request access to, correct, or delete any personal information you have provided to us. We may ask you to verify your identity first, so that we do not hand your information to somebody else.

We will delete what you ask us to delete unless we are required to keep it — for example where it forms part of the record of work we have carried out, or where tax, insurance or other law obliges us to retain it. If we cannot delete something, we will tell you why. We may decline a request to change information if we believe the change would violate any law or legal requirement, or cause the information to be incorrect.

If you are a resident of the European Economic Area (EEA), you have certain data protection rights. We aim to take reasonable steps to allow you to correct, amend, delete, or limit the use of your personal information.

If you wish to be informed what personal information we hold about you, or you want it removed from our systems, please contact us at kevin@bentrivertreecare.com.

In certain circumstances, you have the following data protection rights:

The right to access, update or to delete the information we have on you. Contact us at the address above and we will action it.
The right of rectification. You have the right to have your information rectified if that information is inaccurate or incomplete.
The right to object. You have the right to object to our processing of your personal information.
The right of restriction. You have the right to request that we restrict the processing of your personal information.
The right to data portability. You have the right to be provided with a copy of the information we have on you in a structured, machine-readable and commonly used format.
The right to withdraw consent. You also have the right to withdraw your consent at any time where we relied on your consent to process your personal information.

We may ask you to verify your identity before responding to such requests.

You have the right to complain to a Data Protection Authority about our collection and use of your personal information. For more information, please contact your local data protection authority in the European Economic Area (EEA).

Children

This Website is intended for adults arranging work on a property. It is not directed to children, and we do not knowingly collect personal information from any child.

We do not knowingly collect personal information from children under 13, as that term is used in the Children’s Online Privacy Protection Act (COPPA). Separately, because using this Website means asking us to quote and carry out work, no one under 18 should submit information through it. If you are under 18, please do not provide any information about yourself to us — ask a parent or guardian to contact us instead.

If we learn that we have collected personal information from a child under 13 without verifiable parental consent, we will delete it. If you believe we may hold information from or about a child, please e-mail us at kevin@bentrivertreecare.com and we will delete it.

Commitment to Data Security

Every page of this Website is served over an encrypted HTTPS connection, and what you submit through the quote request form is encrypted in transit. Enquiries are held in our customer management system, which is access-controlled.

One of the best protections we can offer is not holding information in the first place: this Website has no accounts and no passwords for you to look after, does not take payment, and never asks for card or bank details. If anyone contacts you claiming to be us and asks for a card number or bank details in order to book work through this Website, it is not us.

Unfortunately, the transmission of information via the internet is not completely secure. Although we take reasonable measures to protect your information, we cannot guarantee the security of personal information transmitted to us, and any transmission is at your own risk. Text messages in particular are not an encrypted medium, which is worth bearing in mind when you send us a photograph.

Changes to Our Privacy Policy

It is our policy to post any changes we make to our privacy policy on this page. The date the privacy policy was last revised is identified at the bottom of the page. You are responsible for periodically visiting our Website and this privacy policy to check for any changes.
